혐오표현 규제의 필요성에 영향을 미치는 요인에 관한 연구

Abstract

한국 사회에서 혐오표현은 분열과 갈등을 야기하는 보편적 정서로 자리 잡았다. 스마트폰과 SNS가 보편화되고 혐오가 상업적 목적과 결부되면서 혐오표현은 온･오프라인에서 빠르게 확산하며 큰 영향을 미치고 있다. 혐오표현은 공포심, 불안감 및 자기 검열 등의 부정적 영향을 끼친다. 이러한 상황에서 혐오표현 규제 필요성에 대한 논의가 거시적 차원에서 활발하게 이루어지고 있다. 반면, 혐오표현 규제에 대한 미시적 차원의 연구는 드물다. 이 연구에서는 커뮤니케이션학과 심리학 이론을 토대로 혐오표현 규제의 필요성에 영향을 미치는 요인을 분석했다. 연구결과 혐오표현이 범죄로 이어질 가능성이 크다는 인식과 혐오표현은 한국 사회에서 잠재된 차별의식이 드러난 결과라는 인식이 강할수록 혐오표현 규제 필요성에 대한 동의 정도가 높게 나타났다. 또한 여성보다는 남성이, 학력이 낮은 사람일수록 규제 필요성에 대한 동의 정도가 높았다. 이 결과는 혐오표현을 얼마나 알고 있는가와 혐오표현에 대한 경험 정도가 혐오에 대한 부정적 인식을 강화하고 그 강화된 인식이 혐오표현 규제 필요성에 영향을 미치는 구조가 작동하고 있다고 해석할 수 있다. 연구결과에 대한 법적･제도적 함의를 함께 논의했다.

Hate expression has been regarded as a universal emotion that causes division and conflict in Korean society. It spreads rapidly both online and offline and exerts a great negative effects on people and self-censorship. In the context, discussion on the need for regulation on hate expression are taking place at the macro level. On the other hand, micro level studies on why people think hate expression should be regulated are rare. The current study, based on the theory of communication and psychology, attempts to identify factors affecting the need for hate expression regulation. Results show that the stronger the perception that hate expression is likely to lead to crime and that hate expression is a result of revealing a latent discrimination in Korean society, the higher the degree of agreement on the need for regulation of hate expression. In addition, the degree of agreement on the necessity of regulation was higher among men than women and those with lower education level. Overall, the findings imply that the structure in which how much they experience and know hate expression reinforces the negative perception of hate, and that the reinforced perception affects the necessity of regulating hate expression is working. The implications of the findings were also discussed.
