피고인의 사회경제적 지위 및 피해자와의 관계에 따른 아동학대 사건 판단

Abstract

본 연구에서는 아동학대 사망사건에 있어 피고인의 사회경제적 지위 및 피해자와의 관계에 따라 피고인에 대한 판단에 차이가 나타나는지 살펴보았다. 즉, 아동학대 사건에서 피고인이 친부일 때와 양부일 때, 더불어 피고인이 변호사일 때와 무직일 때, 피고인 비난과 반성의 진정성, 개선 가능성에 대한 판단이 달라지는지 조사하였다. 또한, 판단자의 사회지배경향성 수준이 피고인에 대한 판단에 미치는 영향을 피고인의 사회경제적 지위가 조절하는지 알아보았다. 20-50대의 총 240명(남성 112명, 여성 128명)을 대상으로 연구한 결과, 피고인이 친부일 때보다 양부일 때 범행 고의성을 더 높게 판단하여 피고인을 더 비난하고, 반성의 진정성 및 개선 가능성은 더 낮게 평가하였다. 또한, 피고인이 변호사일 때보다 무직일 때 상황 영향력을 더 높게 판단하여 피고인 반성의 진정성과 개선 가능성을 더 높게 평가하였다. 더불어, 피고인이 변호사인 경우에는 판단자의 사회지배경향성이 강할수록 피고인을 덜 비난하였다. 마지막으로 본 연구의 한계 및 시사점에 대해 논의하였다.

The study explored if judgment of child abuse differed by offender’s socioeconomic status and relationship to the victim. We investigated if judgment of offender blame, sincerity of regret, and possibility for improvement differed by offender’s socioeconomic status and relationship to the victim. We also examined if the effect of social dominance orientation on the offender judgment was moderated by offender’s socioeconomic status. Based on a sample of 240 people(112 males, 128 females) aged between 20 and 59, the study revealed that the effect of offender-victim relationship on offender judgment was mediated by the people’s perceived level of offense deliberateness, and the effect of offender’s socioeconomic status on offender judgment was mediated by the people’s perceived level of power of situation. Additionally, for people with strong social dominance orientation, judgment of offender blame was less for an offender with high socioeconomic status. Finally, limitations and implications of the study were discussed.
