중기 청소년기 경찰접촉에서 인식한 절차적 공정성이 후기 청소년의 법의식에 미치는 영향: 경찰에 대한 태도의 매개효과를 중심으로

Abstract

본 연구는 청소년기에 경찰로부터 조사를 받는 경험을 하게 될 경우 경찰의 절차적 공정성에 대한 인식에 따라 법의식과 경찰에 대한 태도에 차이가 나타난다는 것을 검증하고자 하였다. 또한, 절차적 공정성이 법의식 형성에 미치는 영향에서 경찰에 대한 태도가 이를 매개한다는 것을 검증하고자 하였다. 이를 위해 만 13세에서 만 18세의 중기 청소년기에 범죄 피해, 범죄 행위, 비행으로 조사를 받았거나 참고인으로서 경찰접촉 경험이 있는 만 19세에서 만 24세의 후기 청소년 83명을 대상으로 연구자료를 수집하여 분석하였다. 연구 결과, 중기 청소년기의 경찰접촉 경험에서 경찰의 절차적 공정성을 높게 인식할수록 후기 청소년의 법의식이 높은 것으로 나타났다. 다음으로, 중기 청소년기의 경찰접촉 경험에서 경찰의 절차적 공정성을 높게 인식할수록 후기 청소년의 경찰에 대한 태도가 긍정적인 것으로 나타났다. 마지막으로, 중기 청소년기의 경찰접촉 경험에서 경찰의 절차적 공정성을 높게 인식할수록 후기 청소년의 법의식이 높게 나타나고, 절차적 공정성이 법의식 형성에 영향을 미치는 과정에서 경찰에 대한 태도가 이를 매개하는 것으로 나타났다. 이러한 연구결과를 통해 중기 청소년기에 경찰로부터 조사를 받는 경찰접촉 경험이 있을 때, 경찰의 절차적 공정성이 법의식과 경찰에 대한 태도를 형성하는 데 영향을 준다는 것을 확인할 수 있었다. 이는 경찰이 청소년에 대한 법교육기관으로서의 역할을 수행하며, 청소년에 대한 경찰의 조사 과정이 절차적으로 공정할 필요가 있다는 것을 시사한다.

The study examined how legal consciousness and attitudes towards police can differ based on perceptions of procedural justice when contacted by police during middle adolescent period. We further examined whether attitudes toward police mediate the relationship between the perception of procedural justice and legal consciousness. Total of 83 late adolescents aged between 19 to 24 who experienced police contacts for crime victimizations, criminal behaviors, or as a witness during their middle adolescent period (aged between 13 to 18) participated for the study. The study results suggested that participants who contacted with police during their middle adolescent period with higher procedural justice perception were more likely to have higher legal consciousness and more likely to have positive attitudes towards police. Further analysis suggested that attitudes toward police fully mediated the relationship between the perception of procedural justice and legal consciousness. The results confirms that contacts with police during middle adolescence influences procedural justice perceptions, which in turn, influences attitudes toward police. It implies that police can take on a role of a legal educational institution to adolescents and thererfore, the investigation process on adolescents should be procedurally just.
