한국 국회의 실질적 대표성 증진의 조건: 여성 관련 법안 사례

Abstract

의회의 대표성은 성공적인 대의민주주의 운영에 필수조건이다. 대표이론에 따르면 의회의 대표성은 4개의 하위차원의 대표성으로 구성되어 있으며 그 가운데 실질적 대표성(대표자가 개인이나 집단의 요구에 부응하여 정책형성을 추구하는 것)이 의회의 대표성과 직접적으로 연관되어 있다고 주장을 한다. 그리고 인구사회적 대표성은 실질적 대표성과 결합하여 의회의 대표성을 증진시키는 작용을 한다고 주장한다. 이러한 논의에 기반하여 이 논문은 18-20대 국회의원의 인구사회적 변수와 여성가족위원회 소관 법률안의 내용분석을 통해 한국 국회의 인구사회적 대표성과 실질적 대표성의 관계를 분석하고, 나아가 실질적 대표성을 촉진·제약하는 요인들은 무엇인지 분석한다. 통계분석 결과 인구사회적 대표성은 실질적 대표성의 전제조건이라는 것이 확인되었다. 그리고 법안의 성격, 정치행위자의 역할, 사회적 맥락의 상호작용이 한국 국회의 실질적 대표성을 조절하는 것으로 나타났다. 이런 결과를 통해 한국 대의민주주의하에서 직접민주주의적 가치를 실현시킬 수 있는 요소로써 의회 대표성의 함의를 토론해본다.

Legislative representation is an essential component of the success of representative democracy. According to representation theory, legislative representation is made of the four sub-representations, and substantive representation(a representative responds to the needs of an individual(or a group) in the law-making process), among other things, is directly related to legislative representation. And descriptive representation indirectly influences legislative representation by boosting substantive representation. Based on these arguments, this article analyzes demographic data and examines the contents of bills of Gender Equality and Family Committee in the 18th - 20th Korean National Assemblies in order to test the relationship between descriptive representation and substantive representation and factors constraining substantive representation of members of the Korean National Assembly. The findings show that descriptive representation is a precondition of substantive representation. In addition, the interplay between the characteristic attribute of bills, the role of political actors and social context mediates substantive representation. We discuss the implication of legislative representation that is feasible to materialize the value of direct democracy under representative democracy.
