Abstract
연구목적: 유엔아동권리협약의 아동의 의견 존중 원리와 최상 이익 원리가 갈등의 소지가 있음을 밝히고, 두 원리의 개념적, 실천적 조화 방안을 제시한다. 방법: 두 원리가 각각 기초하는 선택이론과 이익이론을 해석하여 그 규범적 방향이 중첩됨을 제시하고, 권리 유형을 재구조화하여 두 원리의 상호보완적 관계를 논증한다. 아동이 두 원리를 조정하는 역량을 발달시킬 수 있는 방안을 도출한다. 결과: 의견 존중 원리는 자율적 선택을 중시하지만 최상 이익 원리는 이익 최대화를 위해 성인의 개입을 허용하므로 두 원리가 충돌할 수 있다. ‘열린 미래를 향한 권리’를 통해 두 원리가 개념적으로 조화될 수 있다. 아동의 선택 능력과 이익이해 능력의 발달이 두 원리의 통합에 관건이므로 ‘발전하는 역량’의 지도 방향을 제시한다. 결론: 협약의 일반원리가 규범과 실행 차원에서 조화되는 방안을 제시하고, 아동이 권리를 행사할 수 있는 발달의 방향을 제안하여 아동권의 해석과 이행을 진전시키는 데 기여한다.
Objectives: This study aims to coordinate the differences between the principles of respect for the views of the child(RVP) and the best interests of the child(BIP) of the Convention on the Rights of the Child as they may diverge. Methods: This study attempts: (1) to examine choice theory and interest theory from which normative orientations of these principles are respectively drawn; (2) to enhance a balance between them by deploying the notion of the child’s ‘right to an open future’ and the child’s ‘evolving capacities’; and (3) to present ways to develop these capacities. Results: The RVP, based on choice theory, is to respect the autonomous choice of the child in the decision-making process. The BIP, based on interest theory, is to give primacy to the child’s wellbeing that could be pursued by adult intervention. Such division can be reconciled by the notion of the child’s right to an open future. At a practical level, this study concentrates on the evolving capacities by which children can acquire competences and develop them towards the full realization of their rights. Conclusions: This study is expected to contribute in promoting a valid way of interpretation and implementation of the child’s rights.
