공정거래제도 4반세기의 역사와 전망

초록

The Monopoly Regulation and Fair Trade Act of Korea (MRFTA) has experienced a remarkable growth through the last quarter century. Many developing countries and transition economies try to learn from Korea's experiences in introducing and developing anti-monopoly regulations. However, MRFTA has to go further to evolve into a more advanced competition law. It has to focus more on anti-competitive behaviors, such as cartels and mergers, rather than Chaebul, which is Korean conglomerates, or unfair trade practices. The fostering of economic analysis is crucial for the task. And courts should expand their roles in implementing the act. These innovative efforts could help MRFTA to meet the global standards of competition policies and to play a leading role in the formation of international competition policies.
