초록

The establishment and successful management of research institute of Association of Asian Constitutional courts would provide foundation for the Asian Human Rights System in future. Moreover, the research of the institute will be able to prepare such visions for the Association of Asian Constitutional Courts(AACA), in which the Korean constitutional court takes an affirmative and leading role, that the Association should authorize and support the research institute with adequate mandate, goals, statue, and sources so that it may work out for building and encouraging Asian Human Rights System including the establishment of Asian Human Rights Court. Although the research institute is a branch of AACA and also will be organized and governed by the Korean Constitutional Court, it should be independent or autonomous enough institute to perform research and make meaningful research proposals and reports to encourage human rights protections in each country, to provide necessary education and training, and to make accountable the persons and governments who are in charge of human rights protection, or those who violate human rights in Asian countries, for the time being as there is no organization for human rights in Asia. From this point of view, this article takes a serious consideration of the human rights system in other regions, in particular, the Inter-American Institute of Human rights, which is the institute charged with functions and responsibilities of researching and educating human rights and human rights system. Accordingly, it would contribute to give guidance for the functions and mandates of the research institute of the AACA in Korea that will eventually become a cornerstone for building Asian Human Rights System.
