The issue of anti-discrimination law have been discussed since mid-2000 and the enactment of anti-discrimination law is one of the key issues in Korea. However some issues such as harassment have not been sufficiently dealt with. All of the anti-discrimination bills regards harassment as one of the types of discriminatory actions; in other words, harassment is a prohibited action in anti-discrimination act. However we have not fully discussed the reason why harassment should be prohibited. In the meantime, stalking, bullying, or violence were also addressed in the name of harassment. We here to make a comparison between these terms. In the Act on the Prohibition of Discrimination against Persons with Disabilities, Remedy against Infringement of their Rights, Etc, harassment means a kind of violence against Persons with Disabilities. In the stalking bills, the term, harassment, is used but this means repeated stalking and unwanted contact as a form of criminal offences. More importantly, in 2018 harassment at workplace is legally prohibited. This means that it is needed to discuss harassment in anti-discrimination law again. To enact anti-discrimination law, it is necessary to make a differentiate several terms of harassment. In addition, because sexual harassment and hate speech are also related to harassment, it is need to discuss how to systemically align these terms.
