초록

This study was carried out with the purposes of summarizing the issues raised about the direct election system of the superintendent of education(SoE) and proposing improvement plan. It examined the transition process of the selection system of the SoE until the current system of the SoE's direct election system is settled. Next, the decisions of the Constitutional Court on constitutional appeals of the SoE's election system were summarized. And, it was summarized the problems and issues of the current selection system of the SoE, and was suggested policy measures to improve the election system of the SoE. This study proposed a plural plan for the improvement of direct electoral system of the SoE. The first plan is to prescribe the resurrection of the board of education on the basis of the direct election of the residents and to form the board of education as a collegiate enforcement agency and the SoE shall be appointed the board of education or the school management committee, or city and provincial councils. The second plan is to elect members of the board of education as a city and provincial proportional representation, to form the board of education as a standing committee for city and provincial councils, and to select the SoE by the direct election of the residents or the restricted direct election of the education stakeholder.
