초록

A current issue of important environmental issues is “noise regulation.” In modern society a noise problem comes to be serious gradually. First of all, the legislation about noise regulation, especially “Noise and Vibration Regulation Act” is not sufficient and effective. In relation to comparative law approach a Public Nuisance Control Act of the federal Republic of Germany(for example § 50, §§ 41-43 BImSchG) recommendable. Secondly regulatory instruments are very limited in the “Noise and Vibration Regulation Act.” In particular the instruments of environmental planning is necessary. Today it is important to prevent traffic noise in stage of road planning. In addition, night noise regulation becomes serious. Finally, the Environmental Protection Agency must pursue also to find a proper solution about it.
