초록
The purpose of this study is to reflect on democracy from ‘East Asia’ and ‘everyday life’ perspectives by examining the process of establishing the family laws of Korea and Japan. Korea enacted a new family law, but the law failed to free itself from coloniality. In Japan, strong demands of the GHQ for reformation enabled democracy and constitutional principles to have a powerful influence over the family law. However, the family laws of Korea and Japan had similar features to one another. The family laws of Korea and Japan were involving gender discrimination. The laws normalized the families of heterosexual marriage that were supported by family headship and family registration systems. After all, the family laws of Korea and Japan could not innovate the pre-war legacy but became a foundation for the modern nation-state again.
