- Abstract
- 法典의 編製 修訂은 儒家의 수중으로 들어감으로써, 그들은 이같은 기회를 이용해 대폭적으로 율령의 개혁을 단행했다. 이들에게 주어진 더욱 많은 기회는 儒家의 精華인 禮를 法律條文안으로 끌어들여 법률은 儒家사상이 지배하는 것으로 끝나게 되었다. 이같은 과정은 漢代에서 시작되어 魏晉에서 완성을 보게 되었으며, 晉律의 가장 중요한 특징을 “峻禮敎之防 準五服以制罪”攀 ≪晋書≫ 30 <刑法志>, 927面.攀攀라고 표현한 것은 晉律이 이미 儒家化되었음을 말해주는 것이다.
