- Abstract
- 본 연구에서는 아프리카가 ‘유전자원(genetic resources)'라는 신지식재산권이 강화되면서 작물에 대한 소유권을 더 강하게 주장할 수 있게 되었음에도 불구하고, 바이오 연료 개발에 대한 세계 주요국들의 관심이 쏠리면서 겪을 수 있는 딜레마 상황에 대해서 소개하고 있다. 즉, 바이오 연료 개발에 많은 노력을 기울이고 있는 선진국의 기업들은 전통적인 지식재산권제도 외에도 강화되는 신지식재산권제도를 함께 이용하여 아프리카의 식량과 에너지라는 두 가지 매우 중요한 문제를 더 어렵게 할 수 있다는 것이다. 본 연구에서는 이에 대한 대응책으로 아프리카의 여러 국가들이 자체적으로 지식재산에 대한 보호 시스템을 갖추고, 초기부터 국제적 논의에 참여하는 등 적극적인 자세를 취해야 한다는 것을 강조하고 있다.
