- Abstract
- 이 글의 동기는 한국 법학이 당연히 여겨 왔던 어떤 전제를 재검토하는 데 있다. 한국 법학의 기반이 되고 있는 교과서 법학에서 규범과 사실, 당위와 존재의 엄격 이원론에 입각해서 규범과 당위 법칙을 사실과 존재 법칙에서 완전 분리하고 있는 것이다. 이 이원론의 근거가 되고 있는 신칸트학파의 방법이원론을 거시 사상사에서 다시 조명하기 위해서 제1부에서 형이상학적 이원론과 자연법의 역사를 다룬다. 제2부에서는 1부에서 논한 형이상학적 이원론의 맥락 아래서 신칸트학파의 방법이원론의 계보와 대분류, 한국에서의 영향을 다룬다. 제3부에서는 법의 존재론적 근거로서 사물의 본성론과 조리를 다루고 마지막으로 사회학적 법학과 법현실주의를 법의 존재론적 추구로 예시한다.
