- Abstract
- 본 연구는 현재 우리나라의 아동권리 협약의 유보조항 철회를 위한 구체적 과제를 제시 하고자 거시적 관점에서 국내외 협약 유보조항 및 유보국가의 특성을 파악하고 미시적 관점에서 유보조항과 관련법과의 상충된 점을 살펴보았다. 본 연구결과 첫째, 아동의 면접교섭권 관련 조항을 유보한 국가는 우리나라가 유일하며 최근 관련법인 민법개정 안이 국회를 통과하여 유보철회를 위한 법적 정비를 마친 상태이다. 둘째, 입양허가제 와 관련되어서는 신고절차에 의한 일반입양 제도와 입양허가 기관에 대한 정의의 문제로 많은 논란이 있을 뿐 구체적인 유보철회 방안이 제시되지 못하고 있는 상태이다. 따라 서 본 조항의 취지에 부합하도록 관련법을 정비하고, 입양허가 기관에 대한 정확한 지정 이 필요하다. 셋째, 상소권과 관련되어서는 B규약과 동일하게 유보된 조항으로 본 조항 의 유보철회를 위하여 관련 법률을 재해석하여야 하며, B규약의 유보철회와 함께 유보 철회가 이루어지도록 적극적 조치가 필요하다.
