루소의 시민사회와 인권실현

Abstract

이글의 목적은 루소의 사상을 중심으로 시민사회 속에서 인권(droit naturel et civil), 시민사회(soci？t？ civil)의 개념을 정의하고, 인권이 시민사회를 통해 실현되는 양상을 논리적으로 증명하는 것이다. 이를 위해 먼저 루소의 저서들에서 자연권과 시민권 개념을 정의한다. 둘째, 시민과 사회에 대한 개념 정의를 통해서 시민사회의 개념을 도출하고 이것이 국가와 가지는 관계를 살펴본다. 이 과정에서 인권이 시민사회와 국가에 대하여 가지는 관계와 실현양태가 드러나게 되고, 사회계약과 참여의 의미가 드러나게 된다. 결론적으로 이글은 루소에게 있어서 인권, 시민사회 그리고 국가는 사회계약에 의해 연계되고 있으며, 각 개인이 시민사회를 통해서 자신의 인권을 실현하려는 행위는 ‘공적 영역에의 활동과 토론’ 그리고 ‘사적이익과 공적이익의 조화’라는 의미의 참여와 같으며, 여기에서 인권과 민주주의의 이상적인 관계가 발견될 수 있고 주장한다.

This study aims to conceptualize the meanings of human rights(droit naturel et civil) and civil society(société civil) in Rousseau`s works, and shows how human rights are outwardly performed by the individuals in civil society. In order to do so, firstly, the conceptualization of human rights(natural rights and civil rights) will be done. Secondly, the concept of civil society will be synthesized by defining the meanings of citizen and society. In addition, the relationship between these concepts and Republic(Cité) in Rousseau`s thoughts will be reasoned. This study will naturally include the connections of social contract to all of these concepts, and expose the meaning of participation to Republic in the dimension of the individual, which specifically means that acting for and discussing about the political things, and reconciling private interests with common interest.
