국제합의의 국내적 정당성과 민주적 통제

Abstract

국제합의는 합법성에 의해서만 지지되지는 것이 아니라 다른 요인에 의해 존중되고 준수될 수 있다. 정당성은 국제합의가 사회적으로 받아들여지고 규범적으로 받아들여질 수 있는 속성을 제공한다. 이 글은 정당성을 주목하고, 일반론의 차원에서 정당성의 개념과 기능 그리고 내용을 살펴보는 한편, 사례론의 차원에서 국내에서 도전을 받고 있는 몇 개의 국제합의에 정당성 지표를 적용하여 확인하고자 하였다. 일반론적 차원에서 살펴본 국제법상 정당성 담론은 국제입법에 있어서 비국가화 또는 비국내화의 가속과 행정화의 진전에 인하여 의회의 영향이 감소되는 추세에 있음을 제시한다. 그 해결책은 국제관계행위에 국가 의회의 참여와 영향을 증진시키는데 있다. 우리나라 역시 국제입법에 있어서 국회의 참여와 영향을 높이는 일반적인 노력과 조치가 필요하다. 사례론의 차원에서 살펴본 몇 개의 국제합의에 대한 정당성 조사는 규범적 정당성과 관련하여서는 확정성, 상징적 유효성, 일관성, 부합성을 이용하였고, 사회적 정당성과 관련하여서는 언론에 보도된 여론조사를 간접적으로 활용하였다. 조사 결과는 비구속적 합의인 경우에는 규범적 정당성을 갖추었다고 보기 어렵고, 구속력 있는 법적 형태를 취하는 경우에는 상대적으로 높았다. 사회적 정당성은 규범성 정당성의 조사 결과에 비례하였다. 정당성 조사에서 특히 절차적 정당성이 매우 취약하며, 그 원인은 관련 절차규칙이 불명확하고 의회의 참여와 통제가 매우 제한되어 있다는 데서 나온 것이다. 마지막으로 국회에서 진행되고 있는 조약체결의 국내적 절차를 법률로 규율하려는 입법 시도를 분석하였다. 새로운 조약체결절차법의 초안들은 공통적으로 조약체결의 국내적 절차의 전 과정을 국회의 민주적 통제 하에 두고자 한다. 이 초안들은 조약 등의 국제입법에 국내적 정당성을 제공하는데 기여할 것으로 보인다. 그러나 그 기여가 국제합의의 국내적 정당성까지 제고한다는 것을 의미하지 않는다.

International agreements might not be supported by legality only but also be respected and complied by other factors. Among them, there is legitimacy which can be conceptualized as a property of being accepted socially and normatively. With taking note of legitimacy discourses, this article will generally clarify the concept, function and contents of it and particularly examine legitimacy on some international agreements challenged domestically by means of related indicators. It has appeared there are two trends in the creation of international norm. One is denationalization: the actual competences of international law-making shift from national governments to international authorities. The other is deparliamentarisation: the role and contribution of the executive body is more extensive to the parliament in national spheres. The stronger these trends, the weaker the chain of legitimacy conveyed by national legislature. It is important to enhance the influential contribution of national legislatures in the process of international norm-making. Useful tools for examining the legitimacy of international law can be provided by Thomas Franck. When his indicators of legitimacy which is proposed as determinacy, symbolic validation, coherence and adherence are applied to some bilateral international agreements where Korea is a party, it is found that the strength of international agreement’s legitimacy depends on the forms of international agreement. According to the case studies, non-binding agreements were hardly seen as being legitimate, while legal-binding agreements had relatively stronger normative legitimacy. It seems that the outcomes result from the indeterminacy of procedural rules and the limit of parliamentarian control in making international agreements. Social legitimacy was found to be correlative to normative legitimacy. Last, this article reviewed the Korean parliament’s draft bills of treaty-concluding procedures The bills for democratic control of international agreements seek for the parliament’s domestic involvement through the entire process of policy-making, negotiation, ratification, and implementation of treaties. The bills may contribute to enhanced domestic legitimacy of international agreements including treaties. However, it is difficult to conclude that the overall domestic legitimacy of international agreements will be ensured by simply legislating procedural laws.
