대통령 권한대행에 관한 몇 가지 쟁점

Abstract

헌법 제71조는 대통령이 궐위되거나 사고로 인하여 직무를 수행할 수 없을 때에는 국무총리, 법률이 정한 국무위원의 순서로 그 권한을 대행한다고 규정하고 있다. 대통령 권한대행제도는 대통령 유고시 잠정적으로 헌법이 일정한 자로 하여금 대통령의 권한과 의무를 대신 수행하도록 함으로써 국정공백을 방지하기 위한 제도이다. 헌법상 대통령 권한대행제도는 여러 흠결을 내포하고 있다. 예컨대 대통령 권한대행 사유의 판단권자, 사고시 대통령이 의사표시를 할 수 없는 경우의 권한대행의 기간 등에 관한 규정이 없어 입법적 보완이 필요하다. 무엇보다도 대통령 권한대행자의 민주적 정당성이 매우 취약하다는 문제점이 많이 거론된다. 이러한 근본적 문제점 때문에 많은 헌법학자들은 권한대행자는 현상유지적 권한만을 행사할 수 있다는 견해를 취하고 있다. 그러나 헌법은 권한대행의 권한범위에 대하여 아무런 제한규정도 두고 있지 않다. 이는 권한대행이 상황에 따라 적절하게 대통령의 권한 모두를 행사하라는 것으로 해석할 수 있다. 권한범위는 전적으로 상황에 달려 있다. 현상변경이 필요한 상황이면 권한대행은 현상변경적 권한행사를 해야 한다. 대통령 권한대행의 권한범위를 제한하는 것은 위헌문제를 야기할 수 있다. 따라서 대통령 권한대행은 상황에 따라 대통령의 권한 모두를 적절하게 행사할 수 있다. 현재 국회에 제출된 ‘대통령의 권한대행에 관한 법률안’은 대통령 권한대행의 권한범위를 제한하고 권한대행에게 형사상불소추특권을 부여하고 있다. 대통령 권한대행의 권한범위 제한과 형사상불소추특권은 헌법에 근거규정이 없다거나 평등위반이라는 이유로 위헌문제가 야기될 수 있다. 대통령 권한대행은 상황에 따라 대통령의 권한 모두를 적절하게 행사할 수 있지만, 대통령 권한대행의 권한행사는 사실상·정치상 많은 제약을 받을 것이다. 대통령 권한대행자는 권한대행이 잠정적이라는 것과 자신의 민주적 정당성이 취약하다는 근본적인 문제를 자각하면서 불필요하거나 과도한 권한행사가 없도록 신중에 신중을 거듭하여 직무를 수행해야 한다.

The acting President system intends to prevent the occurrence of the blank of national administration by making the person acting for the President discharge the President's duties on behalf of him. The article 71 of Korea Constitution provides that if the office of the presidency is vacant or the President is unable to perform his duties for any reason, the Prime Minister or the members of the State Council in the order of priority as determined by Act shall act for him. There are some flaws on the acting President system in Korea Constitution. For example, the Korea Constitution does not provide who can decide the beginning of acting President and how long will the period be when the President is unable to perform his duties for any reason. Particularly, the person acting President in Korea Constitution has a serious problem in that he has so weak democratic legitimacy. For that reason many constitutional law scholars insist that the person acting President should exercise President's powers only to maintain status quo. However, the person acting President can exercise all the President's powers according to the situation because the Korea Constitution does not restrain his power and it is necessary for him to perform the President's duties properly in order that the state may normally fulfill its function. I think that is the right interpretation of Korea Constitution. 'The bill of the acting President act' provides for the limitation of the power of the person acting President and his privilege of not being charged with a criminal offense. As described above, however, it is not allowed to limit the power of the person acting President without amendments to the Constitution. Also Korea Constitution endows the President with the privilege of not being charged with a criminal offense. The person acting President can't enjoy the privilege without amending the Constitution. The person acting President should be careful in exercising his powers taking his weak democratic legitimacy into consideration. Probably he will be restricted in reality in exercising his powers.
