‘범죄피해자 권리 및 지원제도 안내서’의 이해도 평가

Abstract

2015년 4월부터 경찰 수사관은 모든 범죄피해자 조사 시 ‘범죄피해자 권리 및 지원제도 안내서’를 피해자에게 의무적으로 교부하여 범죄피해자의 실질적인 권리 보호 및 복지증진에 힘쓰고 있다. 이에 본 연구는 범죄피해자의 권리에 대한 일반적인 인식을 조사하고, 안내문 형식으로 제시되는 범죄피해자 권리의 세부 내용 중에서 일반인들이 정확히 이해하기 어렵다고 판단되는 전문적인 법률용어를 실제로 얼마나 이해하고, 어떻게 해석하고 있는지 살펴보았다. 구체적으로 여대생 73명을 대상으로 안내서에 기재된 어려운 법률용어의 의미를 주관식으로 측정하였으며, 안내서에 대한 일반적인 평가를 조사하였다. 연구결과, 전반적으로 범죄피해자에게 안내서를 제공하는 제도가 매우 필요하다고 인식하고 있었지만 안내서의 내용을 제대로 이해하지 못하고 있는 것으로 나타났다. 안내서에 기재된 법률용어 중 공판조서와 확정판결의 경우, 용어의 실제 의미보다는 용어를 풀어서 해석하는 경향을 보였고, 항고와 재정신청의 경우, 용어가 의미하는 시기를 잘못 인지하였다. 이를 통해 안내서에 기재되어 있는 특정 법률용어의 경우는 사용을 최소화하고 일반인들도 이해하기 쉽게 수정해 제시하거나 용어에 부가적인 설명을 추가해야 할 필요성이 시사되었다. 마지막으로 본 연구결과를 통해 정책적 제언을 제시하며, ‘범죄피해자 권리 및 지원제도 안내서’의 수정 및 개선점을 논의하고자 하였다.

Since April 2015, police investigators have been mandating the Victims' Rights and Assistance Guide for all crime victim investigations to protect the rights of the victims and promote welfare. This study evaluates the general perception of the crime victims rights and examines how the legal terms used in the guide, which are deemed difficult for the general public to understand, are interpreted and understood. Specifically, 73 adult participants were asked to provide meanings of specific legal terms used in the guide and examined the general perceptions of the guide as well. The results showed that participants generally recognized that the system for providing a guide to crime victims was highly necessary, but the contents of the guide were not understood properly. Among the legal terms used in the guide, ‘report of trials’ and ‘final and conclusive judgments’ as well as ‘appeal’ and ‘an application for a ruling’ were poorly understood and misinterpreted. This suggests the need to minimize the use of certain legal terms in the guide and present them in easier for the general public to comprehend or to provide additional explanations to terminologies. Finally, policy implications and limitations of the study were also discussed.
